THE U.S. SENATE SHOULD NOT ELIMINATE OUR RIGHT TO A FAIR TRIAL
"The right to a fair trial is our most precious freedom. A treaty
currently under consideration by the U.S. Senate would deprive
Americans of that right", said Dr. Robert Linnon, President of the
Irish American Unity Conference (IAUC).
Summarizing the position of the IAUC, Dr Linnon continued:
"The Senate should not ratify the proposed Extradition Treaty between
the United States and the United Kingdom (Treaty Document 108-23).
"Under this treaty any American citizen could be taken out of their
home without a U.S. trial, shipped overseas, imprisoned in a foreign
country and forced to face prosecution in circumstances where a fair
trial might be difficult or impossible.
"Also under its terms, Americans could be stripped of their right to
have a U.S. court decide whether the prosecution is:
:: politically motivated, or.
:: based on race, religion, nationality.
Americans citizens could be prosecuted for activities they engaged in
even before the treaty's ratification.
Americans citizens could be imprisoned without trial for up to 60 days
at the request of a foreign government.
"This extradition treaty could put Americans’ rights to a fair trial
in the hands of a court like the infamous ‘Diplock Courts’ of Northern
Ireland. In trials held in those courts, the accused has no right to
silence, no right to a presumption of innocence, no right to a jury,
and none of the other basic rights guaranteed by our American
constitution.
"Our right to a fair trial should not be signed away by the U.S.
Senate."
